Why Red-Flag Laws Are Worse Than You Think

Dana Mathewson

There is a lot of noise -- way too much of it positive -- being made about so-called "Red-Flag" Laws these days. Too many people, in possession of too few facts, are in favor of these, as they seem to think they will cut down on mass shootings. They won't.

This is a great article and I wish I could post the whole thing. I'm going to post the first and last paragraphs and hope you will follow the link to the entire article.
As red-flag laws again take center stage in the statists’ interminable gun control drama, many Second Amendment advocates seem to have dozed off. Objections to red-flag laws have been limited to ex parte hearings and surprise firearm confiscation. But red-flag laws mangle due process in even more violent ways.

[...]  (Hint: all the good stuff is in here)

Red-flag laws fly under our constitutional radar and rely on the public’s willingness to sacrifice essential liberty for a tiny gain in safety (Benjamin Franklin cautioned against this folly in 1775). Seventeen states already have enacted red-flag laws, and bills are on the move in at least six more states. In all cases, essential due process is a casualty.

I'm adding here what isn't in the article, except that it may be implied by the "due process" mention. The "Red-Flag" idea means that you, dear reader, can have your guns taken away just because somebody makes a call to the cops and says you are engaged in suspicious behavior. It doesn't have to be proved. This "somebody" can be a neighbor who has a grudge against you. Or an ex-girlfriend, boyfriend, spouse, or... anyhow, you get the picture. The possibilities of abuse are endless. And you don't get your day in court.

Any more questions? This ain't the U.S. of A. anymore with these laws. Your guns get taken away. If you don't have any guns, your house is turned upside down looking for them, and "they" don't put it back together afterward. Get the picture? These laws make nobody safer.

1 Not to mention the fundamental right to confront one's accuser, and to defend one's self in court. Good God Almighty, we have abandonded reason.

2 And what are we "red flagging?"  The Soviets had a trick; if you  disagreed with the system you were declared mentally insane and put away in a sanitarium. Who is going to define mentally ill?

3 You've both nailed it. But every time there's a shooting, the hue and cry is "DO SOMETHING." As if that will have the desired effect. Sensible people should cry back with the Hippocratic Oath "FIRST, DO NO HARM!"
But the DO SOMETHINGs assume that there actually is something that can be done. Kind of as if there is a switch that can be tripped to shut off mass shootings. But can you flip a switch and stop car accidents? Of course not.
Keep the faith, Bill, as they used to say. And if you have a gun, or guns, don't give them up!

4 Amen Dana!  I like that Hippocratic Oath thing; we should make it the rallying cry for the Second Amendment.
