I wouldn't have thought to do that.
On the other hand e-mail is sometimes unreliable, and even if it is it gives the benefit of the doubt to the workers; if they sue they could win in court, methinks. It's like gettting a letter; unless it was signed for you have no way of knowing if it was actually received.
Of course the government can access the records to see if it was opened, I suppose.
