Does the woman who put Gorilla Glue on her head because she was out of hair gel have a viable lawsuit against the manufacturer?
Some say yes.
The law must assume an expectation of reasonable common sense. One cannot idiot proof the entire world, after all. The fact we've tried, and the fact we've gotten the law involved in everything that makes anyone unhappy, has led to the current mess we are in. Societies cannot function by laws and rules alone. In the end the public has to take some steps for their own protection and defense.
This is a microcosm of the great divide. The Left sees freedom as being doing whatever you want - no matter how crazy - and having law protect you FROM YOURSELF. Conservatives see freedom as being allowed to act in your own interests and allowed to decide what is good or bad for you. To the latter the law is a basic framework mainly designed to punish evildoers who prey on others, while to the former it is a tool to protect the idiot. In the end the leftist view makes endless laws to cover every conceivable situation, and they usually end up being used for things that were never their intent. In short, the nanny state becomes tyrannical. This story may be about a woman gorilla gluing her hair, but it is about a fundamental philosophical difference in our society.
