Texas has every right to take action along her border.
"No State shall, without the Consent of Congress … engage in War, unless actually invaded, or in such imminent Danger as will not admit of delay” (Article I, Section 10)
And there is the Tenth Amendment to the Constitution:
"The powers not delegated to the United States by the Constitution, nor prohibited by it to the States, are reserved to the States respectively, or to the people."
Also the Ninth Amendment states:
" The enumeration in the Constitution, of certain rights, shall not be construed to deny or disparage others retained by the people. ”
The right to be secure from invasion most assuredly is not constrained by the Constitution, nor the right to defend from invasion if the current occupant of the White House willfully refuses to enforce the law in violation of his oath of office.
He swears:
"I do solemnly swear (or affirm) that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States."
He has refused both to obey the law as currently written and to defend the Constutition.
Nowhere is it said control of the border is solely in the province of the United States government. And as it is not it means Texas has every legal right.
If Mr. Biden tries to use force to make Texas comply to his will it's time for Texas to show him what Sam Houston showed Santa Ana.
