I like the part where it says the agents may not have been aware that he was there. That covers a lot of territory, wouldn't you say?

Actually, I'd feel more comfortable if they knew he WAS there and gassed him; he's the main cause of the trouble, in my opinion.

I'd bet you a beer and an order of chicken wings -- hey, neither of us is in New York -- that somebody in law enforcement knew he was there, and just happened to inform the right people that they needed to apply a bit o' gas in a certain area. There are some things you just can't resist doing, after all.
