No King - Except Judges

The U.S Supreme Court has temporarily reinstated the Texas redistricting map after an activist judge issued an injunction based on racial bias but really because it hurts Democrats.


The fact is redistricting is a part of Federalism and it has always been understood it's a privilege of controlling the states. The Federal government was and is a creation of the states, not the other way around, and the power to redistrict is as democratic as it gets; it gives power to state legislatures, which in turn is elected by the People. Like national elections it is a state matter and this iteration of SCOTUS seems to understand that fact.

Nobody said it couldn't be done when Democrats were doing it. 

The very fact that this judge tried to subvert democracy in this instance is proof it is they who are the kings, not us.

1 California had a special election to permit special redistricting which created an additional five Democrat districts. This was in open and specific response to the Texas action, and was for the purpose of countering that action. Now that the Texas action has been reversed, no one is suggesting that California return to its original districts. So CA has five additional Democrats to counter non existant Texas five additional Republicans.

2 Excellent point Bill. If the Texas plan is nullified by a judge then California should have to rescind their gerrymandering.

SCOTUS finally reminding activist judges that states run redistricting, not federal robes. California keeps their extra gerrymandered seats while Texas gets slapped, typical.
