Kavanaugh Betrays Conservatives

I did not have a lot of confidence in Brett Kavanaugh, although I fought for him because I was not going to allow the Left to destroy him for no good reason. But he was a lifelong insider and I suspected he was going to move leftward once he became a Justice, and so he has.

The Daily Caller has the story.

Kavanaugh sided with the liberals on the Court to deny a hearing on three court cases to defund Planned Parenthood.

"The Supreme Court declined to review three cases relating to Republican efforts to defund Planned Parenthood at the state level Monday, over a vigorous dissent from Justice Clarence Thomas.

The dissent was significant because it indicates that Justice Brett Kavanaugh sided with the high court’s liberal wing to deny review of a lower court decision that favored the nation’s largest abortion provider.

"So what explains the Court’s refusal to do its job here?,” Thomas wrote. "I suspect it has something to do with the fact that some respondents in these cases are named ‘Planned Parenthood.'”

"Justices Samuel Alito and Neil Gorsuch joined the Thomas dissent, meaning there were three votes in favor of taking the case. Since four votes are needed for the Supreme Court to take up a case, the opinion indicates that Chief Justice John Roberts and Kavanaugh joined with the four liberals to deny review.

This move could indicate that Roberts and Kavanaugh are loath to take take up an abortion-related question in the aftermath of Kavanaugh’s contentious confirmation. The Court’s new junior justice has generally kept a low profile since taking the bench in October."

So Kavanaugh joins Roberts and the liberals. What does that mean? It means that once again we squandered a wonderful opportunity and at best we have a center-left Justice. And he'll be there for decades. Great.

1 On the other hand this could have been a requirement Kennedy made for actually retiring: Kavanaugh clerked for him, and Kavanaugh was his pick to replace him.  Otherwise Kennedy might still be hanging on like Notorious RBG.

In many ways a bigger problem is that it's clear Roberts turned or was turned (e.g. there are suspicions about his adoptions), meaning before and after the Kennedy to Kavanaugh change, we had a 3-2-4 court.  We won't even know if the court's continued refusal to heard 2nd Amendment cases, most recently Rothery v. Blanas a month after Kavanaugh assumed office, is because there's still a majority who would rule against them, Roberts plus the more to the Left 4.
