How to Remove a Judge without Impeachment

Arizona Rep. Andy Biggs comes up with a novel way to remove obstructionist judges.

Drew Berquist dishes:

The congressman is proposing a new approach that bypasses the traditional impeachment process, which requires a two-thirds majority in the Senate, by invoking Article III, Section 1 of the Constitution.

"Most Americans believe that there is lifetime tenure for a federal judge. That unless impeached, a federal judge can serve until death,” Biggs told Just the News.

"But lifetime tenure is not guaranteed, nor mentioned, in the Constitution. Article III, Section 1 permits a federal judge to serve only ‘during good behavior.’”

Federal judges do not have lifetime tenure.

They can remain on their bench only when they’re engaged in good conduct.

2 Alas, I greatly fear that the standard of "good behavior" was one thing to the drafters of the Constitution but quite another to today's interpreters. This is especially so considering that the current cases deal with politics, and the people on one side of the aisle will consider that their judges are behaving perfectly, in trying to thwart the President, who is on the other side.

4 Very true Dana; the Left has systematically changed the meaning of words to their benefit over the years.

I remember James Carville calling Bill Clinton "the most moral man in America". To us that sounds utterly ridiculous but in HIS lexicon moral meant holding the "correct" political positions, not behaving in a moral fashion.

5 The clause in question is similar to "a militia being necessary" in the second amendment. Fluff, preliminary to the declaratory part of the amendment. In this case it is the predecessor of the part providing for expulsion by means of impeachment. Drew Berquist is an idiot. The idea the a judge could be accused of bad behavior and removed from the bench without impeachment is absurd.
