I really don't know what part of ILLEGAL these judges don't understand. I assume they went to law school and passed the bar (maybe they didn't pass the bar, but rather stopped in every day.)
UC must reconsider policy barring undocumented students from jobs, court rules

Attorneys representing the UC system argued that its policy is justified because hiring undocumented students could run afoul of a federal law that bans the hiring of people without legal status and may provoke retaliation from the federal government.
A three-judge panel, however, ruled that the system’s policy violates California’s Fair Employment and Housing Act and that fear of federal litigation is not sufficient grounds to uphold it.
"The University does not assert that it relied on the requirements of a federal statute or regulation in deciding to not to amend its policy — only on the risks associated with adopting a policy that the federal government might consider unlawful,” states the ruling. "Accordingly, we conclude that the University abused its discretion by relying on an improper justification for continued application of its facially discriminatory policy.”
Federal law is unequivocal; it is illegal to knowingly hire illegal aliens. 8 U.S. Code § 1324a makes it crystal clear you cannot hire illegal aliens. This law goes back to 1907.
Also there is the Immigration Reform and Control Act of 1986 (IRCA) which doubles down on this.
The Supremacy Clause means Federal law trumps state law and this court knows it. This is a purely lawless act.
Which will no doubt be overturned once it gets out of the People's Republican courts and into Federal appeals court.
Meanwhile the Trump Administration needs to fine the University system, even though they have been trying to comply with his order. One wonders how hard they tried, and wonders if they really tried to win this. But that is neither here nor there; the Administration needs to keep the pressure on them lest they throw up their hands "we lost" and get what they no-doubt wanted in the first place.
We have GOT to find a way to discipline judges who openly violate the law.
BTw the plaintiffs whined about how this imposes a burdon on students who have essentially stolen the place of an American at the university in the first place. Oh boo-hoo!
