Another Meddling Jurist

Timothy Birdnow

Another day, another judge encroaching on Executive authority.

Federal judge blocks Trump from dismantling Consumer Financial Protection Bureau: 'The court can and must act'

Act to do WHAT exactly? To restrict the authority of the President over his own employees. That is not following "separation of powers" as this judge claims. The Bureaucracy is entirely under the authority of the President of the United States, not under Congress and not under the courts.

What this does is elevate the bureaucracy to an unique "fourth branch of government" status that is entirely extra-constitutional.

Naturally this judge - Amy Berman Jackson - is an Obama appointee.

In other news involving Obama-appointed judges a judge issued a restraining order banning the Trump Administration from deporting 350,000 Venezuelans.

The judiciary has exposed itself as hopelessly corrupt and out of step with America and must be reined in.

1  To put a stop to it for good it will take all judges to be completely neutral in political affairs with immediate termination if any ruling is made with a political slant. Good luck in trying to get that kind of measure made into law. So for now all we will be able to do is biatch about it.

3 I agree Mike; it's impossible to make judges a-political. BUT  there are things that can be done. For instance, setting term limits on them (yes, that would require a Constitutional amendment.) We can put a recall measure in place where they can face a retention vote. Most state courts have that and there is no reason why the Feds should not be able to do likewise. We can limit the scope of their authority too, making their rulings ONLY apply to specific cases and jurisdictions. We can be strict in not allowing any potential judge to have made any political donations or spoken for any political candidate or his family likewise.

We already have a kind of blacklist in place where senators from the potential judge's home state can blackball them,so there certainly ARE limits on them even now.

There isn't an easy answer but what we are doing isn't working right now. Something has to change.
