A Federal appeals court has blocked a lower court's order to close Alligator Alcatraz, the prison camp for illegal alien criminals in the Florida swamps.
In a 2-1 ruling, the U.S. Court of Appeals for the 11th Circuit in Atlanta issued the stay on the lower court's ruling, which clearly went beyond the jurisdiction of that court. US District Judge Kathleen Williams had issued the original ruling based on environmental concerns and a lawsuit by environmental groups and Indians (mainly the Miccosukee Tribe).
Judge Williams was put on the , U.S. District Court for the Southern District of Florida by Barack Hussein Obama (Peace be upon Him).
Alligator Alcatraz was built in the Florida Everglades, a huge swamp full of dangerous wildlife - like alligators and snakes of all sorts (including Burmese Pythons) and quicksand and a host of other perils to keep the prisoners from escaping. It is a detention center for violent and dangerous illegal aliens, not regular aliens who came without permission slips.
The state of florida operates Alligator Alcatraz, not the Federal government. The facility is just 39 square acres and was built on the site of an old airport - Dade-Collier Training and Transition Airport - which occupied a total of 39 square miles of swampland. The Everglades take up 7,800 square miles of Florida real estate. Somehow I doubt this postage-stamp prison is going to have any sort of environmental impact that wasn't already there from the closed airport.
The plaintiffs in the case used several environental laws to challenge the legality of the facility. According to ABC News:
To pursue a NEPA claim, the plaintiffs relied on another federal law that allows review of "final agency actions" -- actions taken by the federal government at the end of an agency's decision-making process.
But the state and not the feds were the ones making this decision about land owned by the state. Dade-Collier Training and Transition Airport is owned by Miami-Dade county and not the federal government. All environmental laws cited by the plaintiffs in this case apply to the feds and not state or local governments.
Reember, it was already a developed property.
So this Obama judge had no legal leg to stand on and the appelate court spanked her fairly hard, I'm given to understand, in their opinion (which was still just 2 to 1 as there are always Democrats on any court). Alligator Alcatraz will remain opern for business. And that is a very good thing because these are the worst of the worst being sent there. Their stay as guests of the state should not be overly pleasant or easily ended. Like Hotel California, they should be free to check out any time they like but they can never leave there.
Maybe this judge should put her money where her big mouth is and move to the lovely wetlands of south Florida herself....
Judges Elizabeth Branch and Barbara Lagoa, the two appelate court judges who voted to stay the lower court order, were both Trump appointees. This shows the absolutely critical nature of keeping leftists off the courts. Any idiot who thought Trump sucked enough to support Joe Biden in the election is an utter fool; the courts alone was worth the price of admission.
