A Flag or a Banner?

Just a quick thought on the Trump EO to ban burning the U.S. flag.
I was listening to Clay Travis yesterday and he was talking about the flag burning issue and he and Buck Sexton made the usual case and pointed out how a man got 15 years in prison for burning a pride flag but missed what should have been obvious; the American flag is an actual legal symbol of the United States, given special status by Congress and the People whom they represent. A pride flag is just a banner someone thought was nice. It has no legal position in society.
A pride flag is just a trademark logo. Would anyone have been arrested had Cracker Barrel protesters burned a photo of the new logo?
It is not illegal to burn the Confederate flag, nor the Gadsden flag, nor the Bonnie Blue flag. Nor should it be. Those may be "fighting words" but these flags have no legal protection. But the Americna flag is different as it is our official national flag.
Actually two men were jailed for burning the Palestinian flag - in ISRAEL! The Israelis always try to afford their enemies dignity. But this isn't a real flag.
But the Israelis shouldn't have done that; a flag is just a banner until it is formally adopted by a nation.
Trump's arguemnet is more subtle; he isn't going to arrest people for burning their own flags but if what they do leads to violence he wants to prosecute the person who incited it - the flag burner. Naturally this is going to be extended by liberals to pride flags and every other sort of benner.
At any rate what differentiates a flag from something else? The left is trying to lump every sort of banner together. If I have a paunch does that make me a pregnant woman? Anybody?
