Legalized Theft and the War on Drug Manufacturers

This is just wrong.

Purdue Pharma, makers of Oxycontin, has had to shell out $270 million to settle the first of a thousand lawsuits stemming from the opioid addiction epidemic.

It is speculated the innumerable lawsuits may bankrupt the company.

Oklahoma Attorney General Mike Hunter crowed about how this will start to address the problem of opioids:

"The addiction crisis facing our state and nation is a clear and present danger, but we're doing something about it today,"

Sorry, but suing the manufacturer of a product for misuse is despicable and useless. All that will happen is people will stop making needed drugs out of fear of lawsuits. Do we sue the maker of a food processor because someone chops off a finger sticking it in the gadget? Do we sue the electric company when someone sticks a fork in an electrical outlet? But here we have multiple lawsuits because a.a doctor prescribed an addictive medication and b.a patient misused it.

This is out of control and we desperately need torte reform.

I suspect Mike Hunter and the other vampires seeking ill-gotten gains from these lawsuits will have a very different attitude if they are in serious pain and require narcotics.

1 This ought to be illegal, and probably is. It's already illegal (though the left is trying to overturn it) to sue a gun manufacturer when one of his products is used lethally.

2 Until the Wrath of the Lord falls on these litigants and smarmy lawyers they will keep doing this. It's what was wrong with the tobacco settlement; set a terrible precedent.

Hopefully SCOTUS will slap this thing down.

3 We can hope. That means SCOTUS would actually have to agree to take the case, and whether this thing is a matter of Constitutionality remains to be seen. Does Roberts have the stones? Are the new guys as good as we've been told?
I sure wish Dubya had NOT appointed Roberts to the top seat! Thomas was much better suited.

6 Amen Dana! Roberts has NEV ER been the man for the job, in my view. I wrote a never published essay saying so back when Bush appointed him (I was universally despised by conservative media for urinating on their parade at the time.)  I can see Roberts - and perhaps the new guys as well - arguing that federalism restricts them from interfering. Balderdash!  This is a clear violation of the drug companies rights. The Fourth, Fifth, and Eighth Amendments are all applicable here. But I can see Roberts using the same twisted logic he used in the Obamacare case to argue for federalism and allow endless litigation to destroy the pharmaceutical industry.

If this continues nobody is going to manufacture or innovate pharmaceuticals. How many people are going to suffer and die because some trial lawyers convince irresponsible patients that this is their lucky day?
