Yes, I think you're right; Kavanaugh was guilty for following the rules laid doewn by an unjust society, as they see it. He is getting exactly what he deserves. He's being punished for not doing what he is supposed to do.
Makes me think of Arthur Koestler's Darkness at Noon. The main character was promised that, in the pworker's paradise that was eventually to come, he would be an honored hero of the revolution, but for now he had to confess his guilt and die. He had a conscience, you see, and that couldn't be allowed in the drive to create the dictatorship of the Proletariate.
